1. Acceptance of Terms
By accessing or using Mintiq ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
2. Description of Service
Mintiq is a marketplace platform that connects clients with experts. Experts provide personalized programs based on their knowledge and expertise. The Service includes:
- Expert profiles and marketplace browsing
- Questionnaire creation and completion
- Program generation and delivery
- Payment processing
- Communication tools
3. User Accounts
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
4. Expert Responsibilities
If you are an Expert, you agree to:
- Provide accurate credentials and expertise information
- Deliver quality, personalized programs to clients
- Respond to client inquiries in a timely manner
- Comply with all applicable laws and regulations
- Not misrepresent your qualifications or expertise
- Maintain confidentiality of client information
5. Client Responsibilities
If you are a Client, you agree to:
- Provide accurate information in questionnaires
- Use programs for lawful purposes only
- Respect expert intellectual property
- Make timely payments for services
- Not share or redistribute programs without permission
6. Payments and Fees
For Clients:
- You agree to pay the stated price for programs
- Payments are processed through Stripe
- All sales are final unless covered by our refund policy
For Experts:
- Mintiq charges a 20% platform fee on all transactions
- You receive 80% of the program price
- Payouts are processed via Stripe Connect
- You are responsible for applicable taxes
7. Refund Policy
Clients may request a full refund within 30 days of program purchase if not satisfied. Refund requests must be submitted to support@mintiq.app. We reserve the right to deny refunds in cases of abuse or violation of these Terms.
8. Intellectual Property
Expert Content: Experts retain ownership of their uploaded content but grant Mintiq a license to use it to generate and deliver programs.
Programs: Generated programs are for the client's personal use only and may not be shared, resold, or redistributed.
Platform: Mintiq and its original content, features, and functionality are owned by Mintiq and are protected by copyright, trademark, and other laws.
9. Prohibited Conduct
You may not:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Upload malicious code or viruses
- Harass, abuse, or harm other users
- Attempt to circumvent security measures
- Scrape or extract data from the Service
- Impersonate others or misrepresent affiliations
- Use the Service for spam or fraud
10. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. EXPERT ADVICE IS PROVIDED BY INDEPENDENT EXPERTS, AND MINTIQ DOES NOT GUARANTEE RESULTS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINTIQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the new Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
